The short version

You can use this site to fill prescriptions, buy supplements, and message a pharmacist. Don't try to buy controlled substances without a valid prescription, don't impersonate someone else, and don't scrape the site. Anything you read here is information, not a substitute for medical advice from your doctor or pharmacist. California law governs.

1. The agreement

These Terms ("Terms") form a contract between you and Phoenix Pharmacy ("Phoenix"). By using this website, creating an account, or placing an order, you agree to them. If you don't, please don't use the site — call us at (714) 690-0349 instead.

2. Eligibility

You must be at least 18 years old to create an account or place an order. By using the site you represent that you are. Pediatric prescriptions are filled in the name of the minor but ordered by a parent or guardian.

3. Your account

We use magic-link email authentication — we don't store passwords. You're responsible for keeping access to your email address secure and for everything that happens under your account. Notify us immediately if you suspect unauthorized access. We may suspend or close accounts that show fraud, abuse, or repeated payment failures.

4. Orders & pricing

Prices are listed in U.S. dollars and may change. Sales tax is added where required. We try hard to keep the catalog accurate; if a product is mispriced or out of stock after you order, we'll contact you, and you may cancel for a full refund. Order confirmation emails are receipts, not contracts — Phoenix may decline any order for any lawful reason.

5. Prescriptions

Filling a prescription is a regulated clinical service, not an online retail transaction. We will only dispense a prescription medication when:

  • A licensed prescriber has issued a valid order, including a confirmed bona-fide prescriber-patient relationship
  • The patient (you, or someone for whom you are an authorized agent) has consented to dispensing
  • The pharmacist on duty determines the prescription is appropriate based on professional judgment

The pharmacist may decline to fill any prescription that, in their professional judgment, would be unsafe. Controlled substances are governed by additional federal (DEA) and California (CURES) rules and may require in-person verification.

6. Supplements & non-Rx items

Dietary supplements (Metagenics and other brands) sold on this site are not intended to diagnose, treat, cure, or prevent any disease. Statements made about supplements have not been evaluated by the FDA. Talk to a pharmacist or your physician before starting a new supplement, especially if you take prescription medications.

7. Not medical advice

Articles, journal entries, and educational content on this site are for general information. They are not a substitute for personal advice from a licensed clinician who knows your full history. If you have a medical emergency, call 911.

8. Prohibited conduct

You agree not to:

  • Submit false or stolen prescription information
  • Impersonate another person, prescriber, or facility
  • Use the site to obtain controlled substances outside of a valid prescription
  • Scrape, crawl, or systematically harvest content from the site
  • Reverse-engineer, decompile, or interfere with site security
  • Send malware, phishing content, or unsolicited bulk messages through any contact form

9. Intellectual property

The Phoenix name and logo, editorial content, photography, and the site's structure are owned by Phoenix Pharmacy and protected by U.S. copyright and trademark law. Metagenics product images and descriptions are the property of Metagenics, Inc. and used under our authorized-retail agreement. You may share links and short quotations with attribution; everything else requires written permission.

10. Disclaimer of warranties

The site and its content are provided "as is" without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Phoenix does not warrant that the site will be uninterrupted, error-free, or free of harmful components. This does not limit any warranty that cannot be disclaimed under California law.

11. Limitation of liability

To the fullest extent permitted by law, Phoenix is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or revenues, even if advised of the possibility. Our total liability for any claim arising out of or relating to these Terms or the site is limited to the greater of (a) the amount you paid Phoenix in the 12 months preceding the claim, or (b) one hundred U.S. dollars ($100). This limitation does not apply to liability for death, personal injury, gross negligence, or fraud, or to any liability that cannot be limited under California law.

12. Indemnity

You agree to defend and indemnify Phoenix and its officers, employees, and contractors from any third-party claim arising out of your breach of these Terms, your misuse of the site, or your violation of law.

13. Disputes & arbitration

We prefer to resolve issues directly. Please email legal@phoenixpharmacy.com first; we'll work with you in good faith for 60 days. If we can't resolve a dispute, you and Phoenix agree to binding individual arbitration administered by JAMS in Orange County, California, under its Streamlined Rules. You and Phoenix waive any right to participate in a class action. This section does not apply to small-claims court actions or claims for injunctive relief about intellectual property.

14. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. The exclusive venue for any non-arbitrable dispute is the state and federal courts in Orange County, California.

15. Changes

We may update these Terms. Material changes are emailed to active accounts 30 days before they take effect. Continued use of the site after the effective date constitutes acceptance.
